CONDITION precedent to practise on own account

Applicants to practise on own account require:
  • Attendance and participation in the Flying Start Programme
  • A satisfactory grade in the take home examination
  • An Application pursuant to s30 of the Lawyers and Conveyancers Act 2006 
  • An interview
  • Inquiry that the applicant meets the requirements of Section 30 of the Lawyers and Conveyancers Act 2006 including the requirement that the Flying Start Programme has been successfully completed within three years prior to commencement of practise.

For barristers & solicitors planning to set up practice or entering a partnership.

Any practitioner planning to practise as a barrister sole is encouraged to attend.


Trust Accounting & Business Management
  • The Flying Start Programme is designed for people who are about to take on responsibilities in these areas, to gain some knowledge that they can immediately put to use when entering private practice.
  • All Practitioners wanting to commence practice on their own account, whether as a sole practitioner or as a partner in new or established firms must complete this programme, prior to applying to Council for approval to practise on own account. Trust Account Supervisors must also complete the Trust Account Supervisor Distance Learning Course.
  • The programme is held up to three times a year.
Practitioners
who have been
in practice on
their own
account may
wish to take
the programme
to refresh their
knowledge.

5. Lawyers and Conveyancers Act (Lawyers: Practice Rules) Regulations 2008

Session One, Going Into Practice, covering financial and practical considerations, Partnership obligations, practice management, potential problems.

Session Two, Trust Accounting & Ethics, includes trust accounting, lending, nominee companies, contributory mortgages, the Law Society's role in maintaining professional standards, practical trust accounting exercise.
